Narcotics offenses refer to violations of the Narcotics Act (BtMG), which include the illegal possession, trafficking, transport, manufacture and distribution of narcotics. This also includes the cultivation of plants for drug production and the financing of drug transactions. The law aims to control and prevent the misuse of narcotics. Concurrent violations of the German Medicinal Products Act (AMG) and the New Psychoactive Substances Act (NPSG) also fall under the scope of narcotics law.
If you are caught in possession of narcotics, the penalty depends on the type and quantity of drugs, the purpose of possession (personal use or trafficking) and your previous convictions as well as the circumstances of the specific offense. The consequences can range from fines to substantial prison sentences. Legal advice is essential to understand your rights and possible defense strategies.
The mere consumption of narcotics is not punishable per se, but possession and acquisition for personal use are prosecutable. The criminal prosecution authorities focus primarily on trafficking and distribution. However, the consequence of drug use can be the withdrawal of a driver's license.
Trafficking in narcotics is severely punished, with penalties ranging from heavy fines to long prison sentences, particularly for trafficking in not small quantities, especially if this is done in a gang, with weapons or to minors. The severity of the penalty depends on the type of drugs, the quantity and, if applicable, the participation in organized criminal groups. In the case of drug addiction, therapeutic measures may be considered instead of or in addition to a sentence.
Depending on the federal state, possession of narcotics is not punished due to state-specific regulations on small quantities if they are only possessed in small quantities.
A lawyer specializing in the field of BtMG can advise and represent you in all aspects of a BtM offense, from the initial assessment to the development of a defense strategy and defense in court. A lawyer can also help to minimize the penalty or work towards therapy.
„Therapy instead of punishment“ (Section 35 BtMG, so-called “35er”) is a provision in the German BtMG that allows people who are prosecuted for drug addiction to undergo therapy instead of serving a sentence. This option requires a willingness to undergo treatment and is intended to contribute to rehabilitation. In addition, there is also the measure of placement in a rehab facility, which, however, is only considered in the case of more drastic effects of narcotics addiction (Section 64 StGB, so-called “64er”).
If your home is searched, you should remain calm, not obstruct the search and contact a lawyer immediately. You are not obliged to provide information to the law enforcement authorities. Document the names of the officers involved and all measures taken. A lawyer can inform you of your rights and ensure that they are upheld.
