The term cybercrime covers criminal acts that are committed using computers or the internet. Individuals, companies and authorities are affected. The aim is usually either to gain a direct financial advantage or to obtain data of all kinds in order to make a profit.

The most common types of cybercrime include data and identity theft, online fraud, phishing, ransomware attacks, hacking and offenses related to cryptocurrencies (e.g. tax evasion and money laundering) and the darknet (e.g. drug trafficking or arms dealing)

The regulations on the criminal liability of cybercrime vary around the world. As a rule, cybercrime is prosecuted in the countries where the damage occurred. However, prosecution can often also take place in the country from which the cybercrime offenses are committed.

Cybercrime is rarely solved by technical means. There is a lack of well-trained specialists everywhere. As a rule, cybercrime offenses are therefore solved using the usual investigative methods, i.e. through covert investigative measures such as the use of trusted persons and undercover investigators or online searches. In some cases, the circle of perpetrators can also be narrowed down using traditional motive research and personal relationships. Finally, some crimes of this type are simply committed carelessly, leaving traces that lead to the perpetrator.

Anonymity on the internet is relative, and the ability of law enforcement agencies to trace digital traces has improved significantly. Even though perpetrators of cyber attacks can remain anonymous temporarily, advanced forensics, the exchange of information between international authorities and the monitoring of internet activity increases the likelihood of identification. Anonymity can hardly be guaranteed, especially if criminal investigations have been initiated. It is advisable to seek expert advice in good time.

If you are caught committing a cybercrime offense, a criminal investigation will begin against you. The exact consequences depend on the type and severity of the offense, but can include fines, prison sentences and other sanctions. In addition, the injured parties can assert civil claims for damages against you. It is important to consult a lawyer specializing in cybercrime at an early stage, who will guide you through the process and develop a suitable defense strategy to protect your rights and minimize the consequences.

A high level of technical understanding is essential for developing an effective defense strategy for cybercrime offenses, as evidence is regularly presented using digital evidence and IT forensic expert reports. On this basis, however, the defense techniques are the same as for all other offenses. In particular, the aim is to shatter circumstantial evidence. In addition, traditional evidence is also used in many cybercrime proceedings, such as witnesses in particular. The credibility of their statements must also be extensively scrutinized in cybercrime proceedings.
